SHANGHAI, CHINA – The iPad 2 has seen record-breaking sales and worldwide popularity, but a barrage of lawsuits has Apple being potentially prohibited from selling it in mainland China. The now-defunct Chinese company Proview International has filed suit claiming they own the “iPad” name and accuse Apple of using it without permission, making the Chinese Amazon.com stop stocking or selling the product for the time being and to pay royalties for use of the disputed name. Apple has been selling the blockbuster tablet in China since 2010.

Chinese officials are reported to have seized a number of items and shipments from online retailers, taking 45 units when the suit was initially announced. Market share for the computing giant has dropped significantly due to investor worries regarding the future sales in the region, and even the venerable iPhone has seen a recent decline in popularity.

The “IPAD” was developed in 1998 by Proview was to be an “Internet Personal Access Device” on their Family line using a Windows system and proprietary components according to the developers. The “IPAD” was poorly received, however, and never saw much success. Consisting of a CRT monitor, small case and a Windows-styled interface, the machine was not a tablet, nor a touchscreen device, but instead something more along the lines of an older iMac workstation.

Proview closed in 2008, citing the global financial crisis and low sales, and has since declared bankruptcy.  Apple contends that it purchased the rights to use the iPad name in ten countries though its Taiwanese subsidiary, while Proview asserts their Shenzhen branch had refused to sell the name and rights, and that the representative who brokered the deal was not from Proview at all.

“We are following Chinese law to maintain our rights. We don’t have a figure in mind for what Apple should pay. The 10 billion yuan ($1.58 billion) figure the media has reported is not among our company’s demands,” said Yang in a rebuttal to speculation of Proview taking advantage of the reputation of Apple products in order to revive the company. Yang also asserted that many other companies have approached them and tried to acquire use of the name for other devices, such as a small tablet aimed towards children. Apple denies these claims.

Company memorandums refer to a possible negotiation between the rival parties, though further litigation is forthcoming. “I think in the future we will sue Apple in the U.S.,” Li Su, a representative of Proview in China, told reporters in Beijing. “We are looking to choose between three different U.S. law firms.
